The legal battle between Apple (NASDAQ:AAPL) and Epic Games isn't looking good for the Fortnite creator, which might be regretting its decision to do an end run around the tech giant's payment system for transactions made from apps downloaded through its App Store.

The judge hearing the case recently said Fortnite can be kept off the App Store until a trial commences next summer, and even then the chance of getting reinstated looks bleak.

Worse still, Epic is now fighting to attract developers to the iPhone X video game console, increasingly taking a hard line to get Apple to pay up.

Last weekend is Fortnite's biggest gaming day of the year so far, and it- would be a real shame if Epic couldn't make it popular this year.

Also Overrated

With the game battling to regain its footing in the App Store and find new purchasers, here are a few lesser-known games that should steal the show during its next chapter.

Cities: Skylines

Ever since it came out earlier this year, "Cities: Skylines" has been gaining steam as an alternative to "SimCity," the mass market success that is the current consensus choice among gamers.

We're still waiting to see how the game performs once it reaches launch relaunch on Aug. 23, but, if it's as successful as it promises to be, it will be a cinch to sell hundreds of thousands of copies once again.

Of course, it's more likely that "Live Sims" will steal C:S:S' crown next month, when it lands on all four remaining platforms.

Club Penguin

To avoid being dwarfed by the grotesque competition of "World of Warcraft" or "Twin Peaks" when it finally does land in theaters across the globe, "Club Penguin" is wise to settle for a spot beside "Pet Rescue" on the home video release schedule.

It will be available Sept. 4 on FreeCell for backgrounds, and torrents have worked their way into everyone's pipe very quickly.
